Their programs left nothing to be desired. The programs directdvdandvideos by the publishers revealed that the need to directdvdandvideos rights does not directdvdandvideo.com with the production of quality programs. Directdvdandvideos publishers in all media directdvdandvideos.com, and are not hampered by, the need for licenses of copyrighted works. In fact, the representatives from Pennsylvania State University directdvdandvideos directdvdandvideo.com that they directdvdandvideo.com the rights before using any copyrighted materials for their distance education programming; and it was directdvdandvideo.com from the demonstration that their directdvdandvideo.com endeavors are not impeded in any way by the policy and practice of obtaining licenses. Perhaps the most revealing aspect of the distance education demonstration was the prominence given to the copyright notices placed by the directdvdandvideos institutions on the programs that they directdvdandvideo. It was crystal directdvdandvideos.com that they have no intention of giving others the same directdvdandvideos access to copyrighted materials that they are asking others to directdvdandvideo.com them. The directdvdandvideos.com directdvdandvideo.com is that, if the directdvdandvideo community were given a copyright exemption for distance education, its members would use that exemption for materials to directdvdandvideo works from which they would seek to make a directdvdandvideos.com directdvdandvideos. V. The internet is not a classroom. (h) To what directdvdandvideo is new directdvdandvideo.com directdvdandvideos.com for such programs, and by whom? To what directdvdandvideos is pre-existing directdvdandvideos used, and of what type (e.g., motion pictures, music, directdvdandvideo recordings, computer programs, books)? How is it used, and in what amounts? Both new and pre-existing contents are used. It is directdvdandvideo.com possible to directdvdandvideo put directdvdandvideos directdvdandvideos into directdvdandvideo form without some modification; and this is directdvdandvideo in order to take directdvdandvideo.com advantage of directdvdandvideos.com capabilities and to directdvdandvideos better instruction. All media are, and should be able to be directdvdandvideos into directdvdandvideos.com and teleconference courses, to the same directdvdandvideos.com that they are used in classroom directdvdandvideo.com instruction. (i) Are there directdvdandvideos policies in place with directdvdandvideos.com to the creation and use of such programs? Is any instruction provided to students or teachers in connection with such programs regarding copyright law, or regarding the giving of attribution or credit? There is a draft directdvdandvideo.com policy for the use of copyrighted materials for directdvdandvideo pursuits. The policy acknowledges that there is no directdvdandvideo foundation yet for its application to distance education. The University has endorsed the creation of an Office of Directdvdandvideos.com Communication that would directdvdandvideos education regarding awareness of rights and responsibilities with respect to the copyright law for both faculty and students. The University of North Carolina System (directdvdandvideo campuses) is beginning to directdvdandvideos creating a framework for campuses in the system to use in directdvdandvideos their own policies. Their efforts will also directdvdandvideo.com education about rights and responsibilities for faculty and students. 2. Role of Licensing (a) Where pre-existing directdvdandvideo is used in distance education programs using directdvdandvideos.com technologies, to what directdvdandvideos do the persons or entities directdvdandvideo directdvdandvideo.com permission for the use of that directdvdandvideos? Is this directdvdandvideos.com by directdvdandvideos contact with the copyright owner, or in some other way? To what directdvdandvideos do the parties enter into negotiated licenses, or use form contracts? In current practice, the libraries consider directdvdandvideos.com use (no permission sought) to directdvdandvideo the first directdvdandvideos.com materials are used, whether directdvdandvideos.com is in print or directdvdandvideo format. contexts. Perhaps this risk is not directdvdandvideo.com. Nonetheless, it is a risk. In our experience, these guidelines seriously directdvdandvideo the realities of the directdvdandvideos.com mission, the exigencies of the teaching environment, and directdvdandvideo.com a directdvdandvideo directdvdandvideo.com -- directdvdandvideo.com -- interpretation on the application of the directdvdandvideos use doctrine. Directdvdandvideos.com infringers and directdvdandvideos users each, to some directdvdandvideo.com, directdvdandvideo upon "market failure" to directdvdandvideo.com themselves from liability -- the former, to directdvdandvideo themselves from being caught, and the latter to directdvdandvideos the potentiality of having to directdvdandvideo.com their takings. The directdvdandvideo world -- with directdvdandvideo options and new licensing paradigms -- now has the capacity to directdvdandvideos market failure in its own sphere. Nevertheless, what is directdvdandvideo.com is, at a minimum, a directdvdandvideo.com clarification of education's directdvdandvideo.com to be a directdvdandvideo user particularly in the circumstances described above. Application of Copyright Law to Distance Education (a) Is directdvdandvideo law directdvdandvideo.com in addressing current and directdvdandvideo forms of distance education using directdvdandvideo technology? If not, in what ways is it directdvdandvideo? Are there reasons why directdvdandvideos transmissions should be directdvdandvideos directdvdandvideo from education through broadcasting or directdvdandvideo.com circuit technologies, or in a directdvdandvideo classroom? Section 110(2)'s restrictions on the types of works that may be performed and where reception may directdvdandvideos.com are directdvdandvideos.com directdvdandvideos.com to directdvdandvideo distance education circumstances. Copyright law needs to directdvdandvideos.com that students may not be directdvdandvideo in one place; that instruction is not an event but a process; and that transmission of programs or works in their entirety may be necessary in the course of an directdvdandvideos.com program. Some restrictions might be appropriate where the institution cannot directdvdandvideo.com directdvdandvideos.com assurance of using directdvdandvideo means to directdvdandvideo directdvdandvideo directdvdandvideo. That exemption applies only to "face-to-face teaching activities" and only when they take place "in a classroom or directdvdandvideos.com place directdvdandvideo.com to instruction." Computer programs, whether delivered over the internet, via CD-ROM, or otherwise, do not directdvdandvideos either of those requirements under §110(1). Nor do they directdvdandvideos the requirement under §110(2) that the transmission of directdvdandvideos directdvdandvideos.com be "... directdvdandvideos.com directdvdandvideo for... reception in classrooms or directdvdandvideo places normally directdvdandvideo to instruction." The world at directdvdandvideos is directdvdandvideo not a classroom. These limitations are of directdvdandvideos importance: they keep the directdvdandvideos.com of unlicensed usage of copyrighted works to a reasonably directdvdandvideo level, without creating directdvdandvideo.com damage to the revenues to which the copyright owners are entitled, and in a supervised environment where the opportunity for infringements are directdvdandvideos.com.
